The following Terms and Conditions govern the "online" sales through the Fondazione Musei Civici di Venezia website ( Please read this document carefully before completing the purchase procedure. Submitting the order implies a full knowledge of said conditions and full acceptance thereof.

1) Introduction

1.1 The online Purchase Order implies the acceptance of the Terms and Conditions herein and constitute a contract between the Purchaser and Fondazione Musei Civici di Venezia. for the sale and purchase of products listed in the "online" catalogue of the Fondazione Musei Civici Venezia Website.

1.2 The Customer binds himself/herself and undertakes to print and store these general terms and conditions  as well as the Purchase Order page upon completion of the “online” purchase procedure in order to comply with the provisions forth by articles 52 and 53 of Italian Legislative Decree 205/06. 

1.3 Acceptance of general sale conditions. The Customer who places an order online fully and unconditionally accepts the general sale conditions including the payment conditions outlined hereinbelow, stating that he/she has read and accepted all the instructions provided under the law provisions mentioned above. Any different term or condition shall be agreed from time to time in writing.


2) The Purchase Order

2.1 Underage minors are not allowed to submit orders online.

2.2 The prices stated in this web price list are inclusive of 22% VAT unless otherwise indicated and are ex warehouse: for the products selected for purchase and/or included in the "Shopping Cart", unit price, total price and the total inclusive of VAT included, expressed in Euro, will be indicated.

2.3. The overall cost of shipment and transport will be clearly indicated and displayed before order completion according to the shipping destination of the products purchased.


3) Product availability

Product availability for the products shown in the online catalogue available is updated automatically by the computerized system. Nevertheless should the product purchased by the Customer be out of stock, Fondazione Musei Civici di Venezia will immediately contact the Customer to offer a replacement product with the same price or deduct the amount from the total of the order.

5) Delivery

5.1 Shipment is available throughout Italy, the Vatican State, the Republic of San Marino, EU countries and worldwide.

5.2 Purchased products will be delivered by courier. Delivery service is inclusive of packaging, shipping and insurance against theft damage or loss that may occur during shipping. The cost of this service will be communicated by our staff via the “order confirmation” and depends on the destination address.

Delivery times

Orders are shipped via a traceable international carrier.  Shipments will be made to all countries on Mondays and on Thursdays immediately after the order.

5.3 The invoice/tax records relating to the purchase will be attached to the purchased products in paper format and delivered at the same time as the products.

5.4 Delivery of goods requires the presence of the Purchaser/Customer or his agent at the address indicated in the order. On receiving the goods, the Customer agrees to promptly check that the consignment is correct and includes all and only the purchased products, and the number of packages corresponds to the number reported in the transport document and the packaging is intact and untampered with. Any visible damage to the parcel and / or the purchased products or any discrepancy in the number of packages must be immediately notified to the carrier/courier by filling in the “with reservation” line in the delivery slip. By signing the delivery slip for acceptance without reservation, the Customer waives any right to lodge complaints based on the appearance and content of the package delivered.

5.5 In case the consignment is returned to the Fondazione Musei Civici di Venezia headquarters and/or is left in storage at the carrier/courier’s depot, Fondazione Musei Civici di Venezia will charge any extra storage costs incurred to the Customer.
If the Customer should not be available at the time of delivery, the local branch of the carrier/courier must be contacted to arrange for re-delivery or for collection at the carrier/courier’s own premises.
Fondazione Musei Civici di Venezia shall not be financially liable for undelivered or unclaimed packages left in storage at the carrier/courier’s depot. The Customer who has been unable to  reach an agreement with the local branch of the carrier/courier for re-delivery or collection at the carrier/courier’s depot, shall be responsible for the outcome of the consignment.
In the event that the courier should deliver an undelivered/unclaimed package to the Fondazione Musei Civici di Venezia headquarters, the Fondazione Musei Civici di Venezia will contact the Customer to arrange re-delivery and request  reimbursement of any storage and shipping costs incurred by the Fondazione Musei Civici di Venezia as well as those yet to be incurred (re-delivery to the Customer). In case the Customer should refuse to pay the costs incurred by Fondazione Musei Civici di Venezia or cannot be contacted to reach an agreement, or following e-mail communications by Fondazione Musei Civici di Venezia to request reimbursement for costs incurred not replied within a reasonable period of time of 7 (seven) days, Fondazione Musei Civici di Venezia shall regain possession of the unclaimed goods.


6) Warranties

6.1 The goods are supported and guaranteed by the producer and are therefore subject to the producer’s modes of action. However, Fondazione Musei Civici di Venezia  guarantees the products marketed for 24 months from the date of purchase, unless otherwise indicated. Any warranty exceeding the statutory 24 months or any extended warranty shall be communicated upon specific request. The 24 month guarantee only covers manufacturing defects or malfunction of the products. The warranty is voided by misuse of the goods purchased, neglect, voluntary damage or any problems resulting from incorrect installation at any time after the sale; furthermore, it only covers the original purchaser and is void in case of sale or transfer of the product to third parties.

6.2 Damage claims or compensation. By agreement, Customer waives any right to damages or compensation and any contract or tort liability of the Seller for any direct or indirect damage to persons and / or property arising from the use or inability to use the products.


7) Right to cancel

7.1 Online sales are regulated by the provisions of Italian Legislative Decree No. 206 of 06/09/2005, containing the regulations governing consumer protection in distance selling, giving the purchaser the right to withdraw from the contract.

7.2 The Right of Cancellation only applies to consumers, i.e., end users who are natural persons acting for purposes which can be regarded as outside his trade or profession.  The regulations do not apply to contracts between businesses, which are excluded from the right to cancel. Such right does not apply to sealed software products once they have been opened by the consumer.

7.3 The consumer is entitled to, without giving a reason, return the purchased items to the seller within 10 working days from receipt of goods. The consumer will be refunded the amounts paid, except costs for delivery and return of the goods (shipping), which shall remain the sole responsibility of the consumer.

7.4 How to exercise the right to cancel:

- During the cancellation period (10 days) a signed written notice of the intention to exercise the right of cancellation must be sent by registered letter with acknowledgment of receipt to the address of the Fondazione Musei Civici di Venezia. This notice shall report: order number and date, invoice number and date, bank account details for the transfer (ABI and CAB codes, Account number of the person to whom the invoice relates). In the event such person should not have a bank account, please provide the bank details of a family member or acquaintance, making explicit mention of authorization to Fondazione Musei Civici di Venezia to credit the refund to such bank account.

- Within 24 hours of receiving the registered letter, Fondazione Musei Civici di Venezia will  email  a "Return Authorization" and the related "Cancellation Code” which is needed to proceed with the return of the goods and must be clearly indicated on the packaging and on the consignment documents.

- The goods returned must be shipped by courier  to the following destination address: Fondazione Musei Civici di Venezia, San Marco, 52 – 30124 Venezia. The Products shall be returned intact and in the same state as when they were received, complete with the original package and of any possible material being part of the packaging. Shipments not in compliance with these indications may be rejected.

- Within 30 working days from receipt of goods, Fondazione Musei Civici di Venezia shall refund  the Customer the full amount relating to products stated in the invoice  with the exclusion of shipping and any other additional costs.


8) Product liability

Complaints must be sent to Fondazione Musei Civici di Venezia  registered office at San Marco, 52 – 30124 Venezia. Fondazione Musei Civici di Venezia shall not be in any case liable for any damages, claims or injuries to the Customer of to third parties  that may result from unlawful or inappropriate use of the products purchased on the website .


9) Product images

9.1 The product images on the website are purely illustrative and non-binding.

9.2 The images of the products sold online  through the website are the exclusive property of Fondazione Musei Civici di Venezia or third parties and are protected by copyright. They may not in any way  be reproduced, published, distributed, modified, displayed, reposted or otherwise used  without the specific consent of the Fondazione Musei Civici di Venezia.


10) Privacy

10.1 Pursuant to Legislative Decree no. 196 of 30/06/2003, Fondazione Musei Civici di Venezia informs its customers that personal data supplied by submitting the purchase order, shall be handled solely for the purpose of order processing, and for commercial, promotional, operational and statistical internal use. Since these functions are essential, in the absence of consent, the order cannot be processed: by placing an order, you authorize Fondazione Musei Civici di Venezia to process personal data for the purposes stated above. Fondazione Musei Civici di Venezia undertakes not to disclose such information to companies that may use them for purposes of commercial information, advertising material or carrying out market research.

10.2 The Customer has the right to request Fondazione Musei Civici di Venezia to be informed on:

- confirmation of the existence of personal data concerning him/her  and the intelligible communication of such data and their origin, as well as the logic used in the case where the data is processed;

- erasure, anonymization or blocking of data that have been processed unlawfully;

- updating, rectification or, where interested therein, integration of the data;

- certification to the effect that the operations as per the above points have been notified to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected;

- the existence of data relating to him/her and have the right to object, on request and free of charge, to the processing of such personal data.

10.3 Personal information submitted by the Customer will be processed by the Data Controller (Fondazione Musei Civici Venezia) and the Data Processor (Fondazione Musei Civici Venezia), in full compliance with the provisions set out in Law Decree. no. 196 of 30/06/2003.


11) Applicable law and jurisdiction

11.1 This contract will be governed by and construed in accordance with the Italian laws in force.

11.2 All disputes that may arise under on in connection to this contract will be under the jurisdiction of the Court of Venice, Italy, without prejudice to any applicable mandatory law provisions for the protection of consumers.
